Terms of service
The agreement between you and Firelit Games. Short, in plain English, and honest about the fact that this is an Alpha.
1. Agreeing to these terms
These terms are the agreement between you and Firelit Games covering Wisp —
the game at firelitgames.com/play, this website, and the accounts behind them. By
making an account or playing, you accept them. If you do not, please don't play; there is no
harm done either way.
You need to be 13 or older to have an account. If you are under 18, please read this with a parent or guardian.
2. Wisp is an Alpha
This matters more than anything else on the page, so it goes near the top.
Wisp is unfinished software being built in the open. It will have bugs. Features will change or be removed. Worlds, card collections and WispCoin balances may have to be reset while the game is being developed, and occasionally something will be lost that we cannot get back. We will warn you where we can and we will try hard to avoid it — but if losing a world would genuinely upset you, that is the honest risk of playing an Alpha.
We do not promise the servers will be available at any particular time, and there is no service level guarantee.
3. Your account
- Give a real email address — it is how you recover your account, and how we tell you your Alpha place has opened.
- One account per person, unless we say otherwise.
- Keep your password to yourself. What happens under your account is your responsibility.
- Tell us at support@firelitgames.com if you think somebody else has got into it.
Alpha access is granted per email address. If you applied for the Alpha, register with the same address you applied with, or the two records will not find each other.
4. How you may use Wisp
Play it. Enjoy it. Tell people about it. Record it, stream it, make videos of it — you do not need our permission and you may monetise them.
Please do not:
- modify the game, or use scripts, bots or automation, to gain coins, cards or items you did not earn;
- attack, overload or probe the servers, or try to reach accounts or data that are not yours;
- sell, trade or transfer accounts or in-game items for real money;
- use Wisp to harass anybody, or to do anything illegal where you are;
- copy the game's code or assets to make a competing product.
Finding a bug and telling us about it is not cheating — it is a favour, and we would rather have it than not.
5. WispCoins, cards and items
WispCoins, cards, packs and anything else you collect are a licence to use them inside Wisp, not property you own. They have no real-world value, no cash value, and cannot be exchanged for money.
- Wisp does not currently sell anything for real money. Everything in the game is earned by playing.
- We may adjust balances, drop rates, prices and the odds on rare cards as the game is tuned. During an Alpha this is expected.
- Items and balances end when your account ends, and are not transferable to anyone else.
If real-money purchases are ever added, we will publish the terms covering them — including refunds — before you can spend a penny.
6. Who owns what
Ours: the Wisp game, its code, art, music, the name and the Firelit Games name and marks. Playing does not transfer any of that to you.
Yours: what you make in the game — your worlds, the Wisps you raise, the names you give them, and anything you write. You keep it. You grant us only the permission we need to run the game: to store it, back it up, and show it to you and to other players where the game is designed to do so.
Screenshots and video of your own play are yours to publish.
7. Ending it
You can stop at any time, and ask us to delete your account by writing to support@firelitgames.com.
We may suspend or close an account that breaks section 4, or where we are required to. Where it is a judgement call rather than something serious or automated, we will tell you why and give you a chance to reply.
We may also stop running Wisp, or end the Alpha. We will give notice on this site if we do.
8. Disclaimers
Wisp is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties about it — not that it will be uninterrupted, error-free, secure, or that it will meet your expectations.
9. Liability
To the fullest extent the law allows, Firelit Games is not liable for indirect or consequential loss, for lost data, lost worlds or lost in-game items, or for loss of profits or goodwill arising from your use of Wisp.
Nothing here limits liability that cannot be limited by law — including for death or personal injury caused by negligence, or for fraud. Some places do not allow certain exclusions, in which case the ones that are not allowed simply do not apply to you.
Because Wisp is free and no money changes hands, our total liability to you is limited to the amount you have paid us, which is nothing.
10. Governing law
These terms are governed by the laws of the State of Texas and the applicable federal laws of the United States, without regard to conflict-of-laws rules. Any dispute that has to go to court goes to the state or federal courts sitting in Texas, and you and we both agree to that. If you are a consumer somewhere else, you keep the protections of your own local law — nothing here takes those away.
11. Changes
We may update these terms. If a change matters, the date at the top of this page changes and we will say so in the game. Carrying on playing after that means the new version applies. If you would rather not accept it, ask us to close your account.
